Terms of sale

Preamble

The Carver Europe website is operated by SDG Distribution, a SAS with a share capital of 37,000 euros, whose registered office is at 114 rue des Vanniers, 40150 Soorts-Hossegor, France (RCS Dax B 500 510 961), distributor of the Carver brand in Europe.

Article 1 – Scope

These general terms and conditions of sale govern all sales made on www.carver-skateboards.eu. The purchase of a product constitutes full and unreserved acceptance of these terms. The terms may be amended; the version in force at the time of the order applies.

Article 2 – Customer account

  • Opening an account and using the site are free of charge
  • Access reserved for personal use
  • The customer must provide accurate and complete information
  • The customer is responsible for the confidentiality of their login details

Article 3 – Intellectual property

The site, its structure and the content produced by SDG Distribution are creations to which SDG Distribution holds the intellectual property rights. The trademarks, logos and images of the manufacturers distributed, including the Carver brand, remain the property of their respective owners. Any commercial use is prohibited without prior authorisation.

Article 4 – Prices

  • Prices in euros including tax for the metropolitan European Union
  • Prices excluding tax for deliveries outside the EU
  • The customer is responsible for any applicable taxes and customs duties
  • Prices may change; the price applied is the one in force when the order is recorded
  • Discount vouchers cannot be combined

Article 5 – Orders

  • Validation of the order (double click + authentication) constitutes conclusion of the contract
  • Confirmation sent automatically by email
  • Tracking available under “My orders”
  • The customer is responsible for any errors in the information entered
  • If a product is unavailable: automatic cancellation and refund if already charged

Article 6 – Payment

Accepted payment methods

  • Bank card (Visa, Mastercard, American Express, Bancontact)
  • PayPal
  • Apple Pay / Shop Pay
  • Instalment payment with Klarna (subject to approval)

The payment methods available are those displayed on the payment page at the time of the order.

Article 7 – Delivery

The goods are handed over to the carrier within a maximum of 24 working hours after order confirmation. Delivery time in metropolitan France: 24 to 72 working hours. The customer is notified by email and can track the order from their customer account.

Delivery is made to the doorstep or on the ground floor. The customer must note any reservations on the delivery note. If the parcel is damaged, contact customer service as soon as possible.

Article 8 – Transfer of ownership

Ownership of the goods purchased is transferred only upon actual delivery.

Article 9 – Right of withdrawal

In accordance with Article L.221-18 of the French Consumer Code, you have a period of 14 days from receipt of your order to exercise your right of withdrawal, without giving reasons and without penalty.

The return should preferably be sent by registered post, within 14 days of sending your withdrawal notice, at the customer's expense. The product must be returned in perfect resaleable condition, with no signs of use and not assembled.

The refund is issued within a maximum of 14 days from receipt of the return or of the proof of dispatch. In the event of a partial return, only the price of the returned items is refunded (excluding outbound shipping costs).

Article 10 – Liability and warranties

SDG Distribution is liable for the products sold in accordance with the regulations in force.

Lack of conformity

The consumer has a period of 2 years from delivery of the goods to act in the event of a lack of conformity. During the first 6 months, the burden of proving the defect does not lie with the consumer.

Hidden defects

SDG Distribution warrants against hidden defects rendering the product unfit for use. The customer has 2 years from discovery of the defect to act.

Article 11 – Protection of personal data

SDG Distribution is subject to the GDPR (2016/679) and to French law no. 78-17 of 6 January 1978. The data collected (name, address, telephone, email, bank details, IP address) is necessary for the management of orders.

You have the right to access, modify, object to, port, restrict and delete your data. To exercise these rights:

Article 13 – Disputes, applicable law and mediation

These terms and conditions of sale are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action.

Failing an amicable settlement, disputes fall within the jurisdiction of the courts of the customer's place of residence at the time the contract was concluded.

Article 14 – Instalment payment with Klarna

Carver Europe offers instalment payment via Klarna, subject to approval of your application by Klarna. This service allows you to pay for your order in several instalments according to the option displayed at the time of payment.

How it works

  • Service reserved for private individuals of legal age, subject to eligibility and to Klarna's approval.
  • The order amount must fall within the limits set by Klarna.
  • The first instalment is charged when the order is validated; the following ones according to the schedule presented before payment.
  • The detailed terms (number of instalments, any fees, accepted payment methods) are displayed in the Klarna interface during payment.

Provider

The service is provided by Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden. Use of Klarna is subject to Klarna's general terms and conditions, available at www.klarna.com/fr. The data required to assess the application is processed by Klarna in accordance with its privacy policy.

Withdrawal and disputes

The right of withdrawal provided for in Article 9 hereof applies. Any question relating to Klarna financing (instalments, debits) should be addressed directly to Klarna via the app or its customer service.
